Distance Selling Terms and Conditions

Effective for all orders placed from 01/09/2025.

Alice Rêve de Merveilles, a sole proprietorship operated by Ms. Alice Fermi, registered with the Bordeaux Chamber of Trades and Crafts under no. 980 053 235, with its registered office located at 344 impasse Lestrade - 33190 ST SEVE, and trading under the name “ALICE FERMI” (hereinafter the “Company”); email address: contact@alicefermi.fr operates an e-commerce site.

The site offers for sale a collection of jewelry (rings, earrings, bracelets, and necklaces) handmade by Alice Fermi.

The metals used for the earring clasps are either gold-plated sterling silver (925/1000 sterling silver coated with a 1-micron layer of 18-carat gold) or solid sterling silver (925/1000).

When browsing the site, you may view each product in detail by clicking on the displayed photograph, which will open a dedicated page including a larger image and a description of the main characteristics of the product.


Article 1 – Purpose

1.1 These General Terms and Conditions of Sale (“GTC”) define the terms and conditions governing the distance sale and delivery of one or more products, as described on the site and in the preamble, hereinafter referred to as “Jewelry.”

The GTC constitute a contract between ALICE FERMI and any adult individual with full legal capacity, acting for purposes other than their professional activity, and placing an order in accordance with the terms set out below. Such individual is referred to in these GTC as “you.”

1.2 The GTC are the only legally binding document applicable to any order placed on the site. By placing an order, you accept these GTC. Any order placed on the site is subject to the GTC in force on the date of the order.

1.3 All information relating to the Jewelry offered for sale under these GTC (prices, names, definitions, detailed descriptions, properties, characteristics, and composition, etc.) is available on the site, in compliance with applicable laws and regulations.

Please note that photographs of products may differ slightly from reality due to your screen settings and the lighting conditions when the photos were taken.

As these are handmade creations, items may present slight irregularities in finish, or variations in size and/or color inherent to artisanal production. Such variations cannot be considered as major defects. The seller cannot be held liable for them, and orders remain valid despite these differences.

In any case, product photographs displayed on the ALICE FERMI online catalog are not contractually binding and do not impose liability on the seller towards the buyer.

Article 2 – Countries

Distance selling of Jewelry is carried out within the European Union under these GTC, this territory being defined as the “Delivery Zone.”

For any territory outside the Delivery Zone, you are invited to contact the Company directly by email at contact@alicefermi.fr

to determine whether the order you wish to place can be fulfilled, in particular with regard to (i) delivery risks under usual conditions, and (ii) potential customs duties.


Article 3 – Prices

3.1 Prices. The amount payable to the Company consists of the following:

  • The price of each piece of Jewelry in euros, excluding tax, plus VAT applicable on the date of the order;

  • Delivery fees in euros, excluding tax or including all taxes as applicable.

The prices of Jewelry and applicable delivery fees are those displayed on the site at the date of your order. They may be modified at any time by the Company, provided you have not yet validated your order as set out in Article 4.

3.2 Payment Methods. To validate your order (see Article 4.4), payment may be made via:

  • Credit Card or PayPal: After confirming your order, the site will ask you to provide your credit card details in a secure space, ensuring data encryption via SSL protocol and certified by an authority. Your card must belong to the CB network or any other network indicated on the site. Once the required information is completed and validated by you, and after approval of payment by your bank, your account will be debited for the full amount including delivery fees. The Company does not store your banking details.

If, for any reason (objection, refusal by the issuing bank, etc.), payment cannot be processed, the order will not be registered and/or will be canceled by the Company.


Article 4 – Orders

4.1 Selection. You may select one or more pieces of Jewelry on the site for purchase. Availability is displayed whenever possible on the site.

Earrings are adjusted to the size indicated on the site. It is your responsibility to ensure that the chosen size is correct before placing the order, as you bear full responsibility for the declared size. Please refer to the sizing information available on the site.

Other Jewelry items are offered in standardized sizes.

4.2 Customer Data. The information you provide to the Company is required to validate and deliver your order. You agree to provide accurate and complete information and acknowledge that the Company cannot be held liable for failure to perform its obligations if caused by errors or omissions in the data you provide.

4.3 Payment. Once your order is validated, the site invites you to proceed with payment as described in Article 3. After payment is made and validated by your bank, the Company and you are bound by the GTC. Orders cannot be canceled except as provided in Articles 5.2, 7.1, and 10.1.

You will then receive an email confirming receipt of your order at the address you provided, including an order summary, estimated delivery times, order number, and a copy of the GTC. Pursuant to Article 1126 of the French Civil Code, you formally accept the use of email for confirmation of your order by the Company.


Article 5 – Delivery, Deadlines, and Returns

5.1 Delivery. The Company will deliver the Jewelry to the address indicated in your order, via a carrier designated by the Company, within the time stated during the order process (maximum 5 weeks). For orders containing multiple items with different delivery times, the Company will wait until all items are available before shipping.

5.2 Failure or Delay in Delivery. In accordance with Articles L216-2 and L216-3 of the French Consumer Code, in the event of a delay or failure in delivery seven (7) days after the maximum delivery date stated, which is not attributable to you, to an unforeseeable and unavoidable third party event, or to a force majeure event, you may cancel your order by registered letter with acknowledgment of receipt within sixty (60) days following the maximum delivery date. If delivery has not taken place between the sending and receipt of such letter, the Company will refund you in full for each undelivered item within fourteen (14) days.

5.3 Receipt. Upon receipt of your order, you must immediately and precisely note in writing on the delivery slip any reservations concerning the condition of the package. If the package is damaged, you must (i) make written, detailed reservations to the carrier, (ii) keep the packaging and its contents in appropriate conditions to prevent further damage, and (iii) notify the Company promptly by email, providing documentation and a copy of the delivery slip including your reservations.

Article 6 – Right of Withdrawal

In accordance with Articles L. 221-18 and following of the French Consumer Code, you have a right of withdrawal for all Jewelry under the conditions set by law.

This right may be exercised within 14 (fourteen) days from the receipt of the Jewelry by you, by sending an email to contact@alicefermi.fr

You must then return the item concerned within 14 (fourteen) days following the communication of your decision to withdraw, in its original packaging or packaging providing equivalent protection, in perfect condition and accompanied by all supplied documents and accessories. This return is at your expense, and the Company will not reimburse return shipping costs, which you expressly accept.

The refund of the returned item (including delivery costs to your address) will be made by credit to your bank account within 14 (fourteen) days following receipt of the item by the Company. Any personalized, altered, damaged, used, incomplete, or soiled item will not be eligible for a refund.


Article 7 – Consumer Law

7.1 The Company complies with the provisions of the French Consumer Code and Civil Code regarding warranties. The seller is responsible for any non-conformity of the goods under Articles L. 217-4 et seq. of the Consumer Code and for hidden defects under Articles 1641 et seq. of the Civil Code.

  • Non-Conformity: A product is compliant if it is suitable for the usual expected use of similar goods, corresponds to the description given by the seller, or possesses the qualities presented to the buyer through a sample or model. It must also meet the legitimate expectations of the buyer based on public statements by the seller, producer, or representative, including advertising or labeling.

  • Hidden Defects: The seller is responsible for defects that make the product unsuitable for its intended use or significantly reduce its value. This includes defects not known to the seller, unless they have expressly excluded such liability.

  • Remedies: If repair or replacement is impossible, the buyer may return the product for a full refund or keep it for a partial refund. Minor non-conformities do not justify cancellation of the sale.

7.2 The Company provides no warranty for hidden defects of which it had no knowledge, nor for Jewelry responding to any specific request from you, except for size when specified. The Company is not liable for damages or non-conformity arising from incorrect information provided by you.

7.3 Any Jewelry returned damaged, used, or soiled beyond the stated non-conformity cannot be refunded.

7.4 The Company cannot be held responsible for:

  • Errors or omissions described in Article 1.3;

  • Interruptions or delays due to maintenance, technical failures, force majeure, third-party actions, or circumstances beyond its control;

  • Temporary inability to access the site due to events beyond its control, such as IT or network outages.


Article 8 – Intellectual Property

8.1 All Jewelry, the Site, services offered, and all content including text, databases, software, visual and audiovisual elements are the exclusive property of the Company and protected under intellectual property law. Any use, reproduction, or representation of these elements is strictly prohibited.

8.2 The “ALICE FERMI” trademark is registered. No license or authorization is granted for its reproduction or any other trademark used by the Company or its partners.


Article 9 – Personal Data

9.1 The Company collects personal data with your consent as described in Article 4.2.

The Company undertakes to collect and process personal data in compliance with EU Regulation 2016/679 (GDPR).

  • Purpose: Personal data is primarily collected to process and execute your orders, to access and use the Site, manage and optimize the Site, verify, identify, and authenticate the data you provide. It may also be used to facilitate future orders, track current orders, or for newsletters if you opt-in.

  • Recipients: Personal data may be shared with third-party service providers only for order fulfillment, customer support, advertising, or payment processing, and in compliance with applicable regulations. The Company may also transfer data in case of legal obligations, complaints, or corporate transactions such as mergers or acquisitions.

  • Retention: Data is stored in accordance with legal limits, depending on its nature and the circumstances in which it was collected.

9.2 You have the right to access, correct, delete, limit, object to processing, and request portability of your personal data. These rights can be exercised by writing to ALICE FERMI, 344 impasse Lestrade - 33190 ST SEVE, or by email: contact@alicefermi.fr 

Rights to deletion or objection may not apply to data necessary for order execution or legal compliance.

9.3 Cookies: The Site uses cookies to ensure proper functioning and improve user experience. By accepting cookies, you consent to their use. Cookies may contain data related to your identification and browsing. You can block or delete cookies in your browser settings.

Article 10 – General Provisions

10.1 Consumer Status: By accepting these Terms and Conditions, you declare that you are purchasing the Jewelry strictly for personal use and not in any way related to your professional activity (i.e., not for commercial, industrial, artisanal, or professional purposes). This declaration is an essential condition for the Company to consent to your use of the Site and the sale provided through it. If this declaration proves false or misleading, the Company reserves the right to cancel your order and retain the amount paid as a provisional penalty, without prejudice to any additional compensation to which the Company may be entitled.

10.2 Site Access: Costs related to Internet usage when accessing the Site are your responsibility, according to the rates and conditions set by your Internet service provider. You remain solely responsible for any equipment and its use that allows you to access the Site.

10.3 Partial Invalidity: If one or more provisions of these Terms are deemed invalid or null under law, regulation, or by a final decision of a competent court, the remaining provisions will retain their full force and effect, unless the invalid provisions are substantial and their removal disrupts the contractual balance. In such cases, the parties agree to replace the invalid provision with one that closely reflects the original intent.

10.4 Non-Waiver: Any tolerance or waiver by either party regarding the enforcement of any part of these Terms, regardless of frequency or duration, shall not be interpreted as a modification of the Terms or create any rights.

10.5 Applicable Law and Jurisdiction: These Terms are governed by French law. In the event of a dispute regarding the interpretation or execution of these Terms, or the order or delivery of Jewelry sold on the Site, you are invited to contact us to resolve the issue amicably by registered letter with acknowledgment of receipt to ALICE FERMI, 344 impasse Lestrade - 33190 ST SEVE, or by email: contact@alicefermi.fr

For disputes regarding the formation, execution, or interpretation of these Terms, the French courts shall have exclusive jurisdiction.

10.6 Modifications: Once in effect, these Terms may only be modified by a written agreement signed by both parties. They represent the entire agreement between the parties and replace any prior oral or written commitments related to their subject matter.
